Despite the fact that the defense is arguing that former BART police officer Johannes Mehserle accidentally shot Oscar Grant on an Oakland BART station platform,
the judge in Alameda County ruled today that there is enough evidence for Mehserle to stand trial for the murder of Grant:An Alameda County Superior Court judge ruled Thursday there is enough
evidence to have former BART police Officer Johannes Mehserle stand
trial on a murder charge for fatally shooting Oscar Grant III.
Mehserle, 27, shot 22-year-old Grant once in the back as he lay face
down on the platform of the Fruitvale BART station early on New Year's
Day.
Police had been called to the station to respond to reports of a fight on a train.
The ruling by Judge C. Don Clay came on the seventh day of Mehserle's
preliminary hearing, which involved testimony by witnesses including
train passengers and Mehserle's colleagues on the BART police force.
Can you imagine the outrage if the judge had ruled differently?
What do you think of this judge's ruling? Does Mehserle deserve to stand trial for murder, or do you think he should have been charged with a lesser offense?
